Nicméně již jsem měl mnoho jednání na různých úřadech a také Vám mohu garantovat, že úředník Vám MUSÍ ukázat podle čeho postupuje a nejste to, vy nejste kdo má tuto povinnost. Ohledně stavebních úřadů jsem zažil mnohdy, že „úředník“ musel přijmout názor a jednat podle toho. Většinou stačilo málo, a to i v případě vlastní stavby RD, kde jsem měl velký důvod si úředníka proti sobě nepoštvat.</span><span style='font-size:12.0pt;font-family:"Times New Roman","serif"'><o:p></o:p></span></p><p class=-wm-msonormal><span style='font-size:12.0pt;font-family:"Times New Roman","serif"'> </span><span style='font-size:12.0pt;font-family:"Times New Roman","serif"'><o:p></o:p></span></p><p class=-wm-msonormal><span style='font-size:12.0pt;font-family:"Times New Roman","serif"'>Nemohu tedy s Vámi souhlasit. A garantuji vám, že nic takového nenajdete. Pro úředníka stavebního úřadu je rozhodující stavební právo, nikoliv právo upravující katastr nemovitostí.<o:p></o:p></span></p></div><div><p class=-wm-msonormal><span style='font-size:12.0pt;font-family:"Times New Roman","serif"'>To, že si katastr zjednodušil situaci a současným pohledem je mu jedno, co je napsáno v některých částech GP, ani zdaleka neznamená, že stejným pohledem se na totéž má a nedej bože dokonce MUSÍ dívat úředník jiného úřadu, třeba toho stavebního.<o:p></o:p></span></p></div><div><p class=-wm-msonormal><span style='font-size:12.0pt;font-family:"Times New Roman","serif"'> <o:p></o:p></span></p></div><div><p class=-wm-msonormal><span style='font-size:12.0pt;font-family:"Times New Roman","serif"'>Takže ve výsledku je to vždy o nějaké vzájemné domluvě a ohleduplnosti. Úředník <u>musí</u> jednat jen podle zákona, ne jinak, nemá jednající volnost. Zeptal bych se, ať mi ukáže předpis a místo, které mu přikazuje a nutí ho takto postupovat (samozřejmě hezky, v úkloně, nejlépe s bonboniérou, ……. Asi ne). Myslím, že takový odkaz nenajde. Zmínil bych se, že je to pro mne obrovská komplikace a bude mě stát (změna GP) nemalé prostředky a že tedy budu muset chtít peníze po úřadu a že tedy musím za panem vedoucím, volat k nadřízenému orgánu …….. . Co je napsané na geometrickém plánu není závazné a rozhoduje listina stavebního úřadu. Zkusil bych úřednici přesvědčit ať vezme stávající geometrický plán, že katastr to zapíše jako rod.rekr.
