        <p class="MsoNormal"><span style="color:#1F497D">rozhodně
            doporučuji právníka vyměnit, tento zjevně nepochopil princip
            „superficies solo cedit“.
            <o:p></o:p></span></p>
        <p class="MsoNormal"><span style="color:#1F497D">Druh by si měl
            uvědomit, že jako stavebník investoval peníze do cizí
            nemovitosti. Pokud z nějakého důvodu nelze upravit
            vlastnictví k pozemku, pak si měl svou investici ošetřit
            jiným způsobem (bezúročná půjčka apod.).<o:p></o:p></span></p>
        <p class="MsoNormal"><span style="color:#1F497D">Právo stavby mi
            nepřijde jako vhodné řešení tohoto případu. Zkusil bych nyní
            uvažovat směrem k vymezení jednotek v RD a převodu některé
            (některých) na druha, tím ale dojde i k převodu podílu na
            pozemku, což, jak píšete, rodinné poměry vylučují :-/.<o:p></o:p></span></p>

            může třeba nastat, když druh/ družka postaví společně dům,
            na pozemeku (tento je jen družky) je zástavní právo,  stavba
            je po výstavbě zapsána do vlastnictví jen družky. Vznikne
            spor mezi druhy a začnou se soudit o určení vlastnictví,
            soud uzná nárok druha na vlastnictví a dá stavbu do
            spoluvlastnictví ……… jak to katastr zapíše? Soud jistě
            nemůže ve svém rozhodnutí říkat, že napřed se vypořádá
            zástava, tato se rozšíří bance i na stavbu a pak se zapíše
            stavba na oba podílníky.<o:p></o:p></span></p>

            návrh se mi zdá „zcestný“, to je ten, že se uměle vyvolá
            soudní spor a soud přikáže (po úvodním jednání, kde se druh/
            družka) po společné dohodě stavbu do jejich podílového
            vlstnictví. Je to drahé, soud cca 5.000 Kč + nějaké náklady
            na právníka, + návrh na vklad, + čas.<o:p></o:p></span></p>
